More updates from the government last week on the Employment Rights Bill, this time including some new amendments not previously known!

 

All are currently still at proposal stage and subject to the usual process of review.

 

Here’s a brief overview of the most important new amendments proposed:

 

🚨A ban on NDAs linked to harassment and discrimination at work🚨

 

➔ Covers any agreement, including settlement agreements and employment contracts

 

➔ Does not cover a failure to make reasonable adjustments

 

➔ Applies to former and current employees

 

🚨Softening the ban on fire & rehire🚨

 

➔ Will now only cover a set of restricted variations relating to pay, pension, hours of work and holiday entitlement

 

➔ Includes an ability by the employer to add a variation clause to contracts

 

➔ Removal of the proposed statutory checklist to assess if a dismissal is unfair

 

🚨A new miscarriage leave🚨

 

➔ Extending current bereavement leave provisions

 

➔ Includes stillbirth or loss of a child in the first 24 weeks of pregnancy

 

There are also changes proposed to whistleblowing laws and the complex zero-hour worker rules, but these changes are not backed by the government and so are unlikely to be passed.
